Il n\u2019est donc plus suffisant pour le locataire de se borner \u00e0 indiquer dans son cong\u00e9 qu\u2019il est \u00e9ligible \u00e0 l\u2019une des cinq hypoth\u00e8ses ouvrant droit au pr\u00e9avis r\u00e9duit, \u00e0 savoir&nbsp;:<\/p>\n\n\n\n<p>\u2022 lorsque le local lou\u00e9 est situ\u00e9 en zone tendue ;<\/p>\n\n\n\n<p>\u2022 en cas d\u2019obtention d\u2019un premier emploi, de mutation, de perte d\u2019emploi ou de nouvel emploi cons\u00e9cutif \u00e0 une perte d\u2019emploi ;<\/p>\n\n\n\n<p>\u2022 pour le locataire dont l\u2019\u00e9tat de sant\u00e9, constat\u00e9 par un certificat m\u00e9dical, justifie un changement de domicile ;<\/p>\n\n\n\n<p>\u2022 pour les b\u00e9n\u00e9ficiaires du revenu de solidarit\u00e9 active ou de l\u2019allocation adulte handicap\u00e9 ;<\/p>\n\n\n\n<p>\u2022 pour le locataire qui, comme c\u2019\u00e9tait le cas dans l\u2019esp\u00e8ce ayant d\u00e9bouch\u00e9 sur l\u2019arr\u00eat du 11&nbsp;avril 2019 rapport\u00e9, s\u2019est vu attribuer un logement d\u00e9fini \u00e0 l\u2019article L.&nbsp;351-2 du code de la construction et de l\u2019habitation.<\/p>\n\n\n\n<p>Il doit d\u00e9sormais de surcro\u00eet, dans le m\u00eame temps, rapporter la preuve de ses all\u00e9gations. <strong>La Cour de Cassation dans un arr\u00eat du 11 avril 2019 n\u00b018-14-256&nbsp; le rappelle&nbsp;: Faute pour le locataire qui souhaite b\u00e9n\u00e9ficier d\u2019un d\u00e9lai de pr\u00e9avis r\u00e9duit de pr\u00e9ciser le motif invoqu\u00e9 et d\u2019en justifier au moment de l\u2019envoi de la lettre de cong\u00e9, le d\u00e9lai de pr\u00e9avis applicable \u00e0 ce cong\u00e9 est de trois mois.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019article 15 de la Loi du 6 juillet 1989, modifi\u00e9e par la Loi ALUR est ainsi r\u00e9dig\u00e9 \u00ab&nbsp;le locataire souhaitant b\u00e9n\u00e9ficier des d\u00e9lais r\u00e9duits de pr\u00e9avis [\u2026] pr\u00e9cise le motif invoqu\u00e9 et le justifie au moment de l\u2019envoi de la lettre de cong\u00e9&nbsp;\u00bb .
